The Los Angeles Fire Department is the Certified Unified Program Agency (CUPA) responsible for the regulatory inspections of all tank facilities subject to Aboveground Petroleum Storage Act (APSA) program in the City of Los Angeles. The main purpose for the APSA inspection is to verify that tank facilities have prepared and implemented a Federal Spill Prevention, Control and Countermeasure (SPCC) Plan. The intent of the SPCC Plan is to ensure preparedness for response to petroleum discharges by describing procedures, methods, and equipment used to prevent such discharges. With the exception to conditionally-exempt tank facilities, all tank facilities must prepare and implement an SPCC Plan that meets current federal SPCC rule requirements. Conditionally-exempt tank facilities are not required to prepare an SPCC Plan under APSA if they meet certain conditions, but conditionally-exempt tank facilities still have reporting and fee requirements.
APSA applies to tank facilities that are subject to the federal SPCC rule, have a total storage capacity of 1,320 gallons or greater of petroleum, or store 55-gallons or more of petroleum in Tanks In Underground Area (TIUGA). In APSA, the term “petroleum” means crude oil, or a fraction thereof, that is liquid at 60 degrees Fahrenheit temperature and 14.7 pounds per square inch absolute pressure.
Requirements
If you are an APSA Tank Facility and not exempt, then you must do the following:
Prepare and implement a Spill Prevention, Control, and Countermeasures (SPCC) Plan.
Submit your Tank Facility Statement and/or Hazardous Materials Business Plan (HMBP) information in the California Environmental Reporting System (CERS).
